Is the Wand of Lightning bolts party treasure? Or do I need to spend my own money?

I did not add the Wand of Lightning Bolt to party treasure but then again, I didn't do the treasure for that. I probably wouldn't have anyway because of the low level. However, now that I look at it again, how can it be 3rd lvl. It is a 3rd lvl spell, requiring the caster to be at least 5th to even craft it. Would that not make the minimum possible caster level 5th? If so, it would be similar to the javelins...5d6 dmg but with a DC 14 Reflex save for 1/2 dmg. Unless I'm missing something.

Kit will take the wand. Never can have to many. But I will wait until Mike clarifies the level of the wand.
